Driver Hits Dog, Then Assaulted by Owner and Juvenile in Weld County

[Weld County, CO.] A driver struck and killed a dog that ran into the road on Weld County Road 45. After stopping to inform and apologize to the owners, the driver was confronted by Anthony Smith (38) and a juvenile male.

WCSO patrol deputies responded to a disturbance the Hudson Police Department had begun investigating but determined it occurred in WCSO’s jurisdiction on Jan. 3 at 3:46 P.M. in the 3300 block of Weld County Road 45.

WCSO patrol deputies learned through interviews and their investigation that the victim was driving on Weld County Road 45 when a dog ran out into the road. The victim could not swerve or slow down and accidentally hit the dog and killed it. The victim parked his car and went to notify the owners and apologize.

The owner of the dog, Anthony Smith and a juvenile male approached the victim screaming.  Smith and the juvenile allegedly assaulted the victim, claimed he owed them money for the death of their dog, and tried to take the victim’s watch. The juvenile allegedly went into the victim’s car and began searching for something of value. After the assault ended, Smith supposedly damaged the victim’s exterior car mirror.

The victim left the scene of the incident and drove to the Hudson Police Department and reported it. The victim was transported and treated for non-serious bodily injuries at a local hospital.

WCSO deputies contacted Smith the same day the incident took place and arrested him on suspicion of:

  • Criminal attempt to commit a class four felony
  • Third degree assault
  • Criminal mischief (under $300 in damages)
  • First degree criminal trespass
  • First degree contributing to the delinquency of a minor

The juvenile involved in the incident was also contacted by deputies and faces charges of:

  • Robbery
  • Criminal attempt to commit a class four felony
  • Third degree assault-causes bodily injury
  • First degree criminal trespass on a motor vehicle

The identity of the juvenile will not be released. No further information will be disseminated today.

All charges are merely accusations, and a defendant is presumed innocent until, or unless proven guilty in a court of law
